After an accident, many people don’t know what to do next.  There are a number of small things you can do to give your case the best chance at being successful:

  • Call 911 Even if the other individual tells you not to, promptly report your accident and injuries to the police. When the police arrive, be cooperative, stay calm, and don’t’ admit fault or assign blame.
  • Document the scene For example, take pictures of the vehicles involved if it was a car accident or the defect that caused you to fall if it is a premises liability case, and also take pictures of your injuries. The more documentation the better.
  • Seek immediate medical attention The longer you wait, the worse you injuries might become. Even if you don’t have visible injuries, the shock and adrenaline from the accident might mask serious injuries. Make sure you tell your doctors exactly what happened and follow the doctor’s recommendations.
  • Do not speak with the insurance company It is very important to first speak with an attorney before signing or saying anything. You do not want to say or sign anything that will cost you the chance at fair and just compensation.
  • Keep a journal.  Doing so will help you remember details that would otherwise be forgotten, details that could help your case at court.  You will want to record information about your disabilities as a result of your injuries such as your inability to drive, your inability to dress yourself, the degree of pain you felt when performing everyday tasks, the amount of help you needed to perform daily tasks, activities you can no longer do, the way the injury changed your life, and any permanent life changes that resulted from your injuries.
  • Keep good records.  You should keep a list of all the doctors you have seen and keep track of doctor bills and all expenses associated with your injuries including home nursing care, special clothing, medications, transportation costs, therapy, injections, and rehabilitation.
  • Do not discuss your injury or how it happened with anyone other than your doctors or attorney, unless your attorney advises you to do so.
